Online Shopping

The Happy Penguin offers the opportunity to purchase products online through this Website. All purchases are subject to the terms and conditions of these Terms of Use and any additional requirements shown on the product or checkout page or in the FAQ. Customers must be over age 18 with a valid credit card. Website visitors under age 18 cannot make purchases. When a customer places an order, we collect information associated with the transaction in accordance with The Happy Penguin Privacy Policy.

Prices: Prices of products and delivery and other charges displayed on this Website are current at the time of issue, but may change at any time without notice and are subject to availability. Stated prices do not include shipping and handling or taxes. You are solely responsible for any sales, local or similar taxes and duties or other liabilities imposed by any governmental agency, including without limitation, any customs duty, goods and services taxes imposed on any products ordered by you from this Website. All prices are stated in United States dollars.

Charges: If you purchase by credit card, we may authorize the amount of your purchase with your credit card issuer at the time you place your order.

Availability: We cannot guarantee availability of product, even if our Website shows that a particular product is available. We may not have all products or product lines available online and we may discontinue products at any time.

Promotions: Promotional pricing may be restricted to defined groups of people for specific periods of time while supplies last. Any promotion may be discontinued at any time and without notice. Please see the terms and conditions for each promotion that may be applicable to your purchase.

Orders: We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. If your credit card has already been charged for an order at the time the order is rejected, declined or canceled, we will issue a credit to the credit card account which was charged.

Shipping/Risk of Loss: We will ship your order to the address you provide in compliance with these Terms of Use. You are solely responsible for any inaccurate or incomplete shipping information. All items purchased from this Website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. In the event your order is lost during shipping, we will assist you in pursuing a claim with the shipper, but will not be liable for any orders which are lost during shipping or misdelivered.

Returns: The Happy Penguin accepts returns only of defective products pursuant to its warranty policy below. You must follow the warranty return process below to initiate a return of a defective product. The Happy Penguin does not accept any other returns.

30 DAY LIMITED WARRANTY/Defective Product Returns:

Every The Happy Penguin product is warranted to be free from manufacturing defects in material and workmanship for a period of thirty (30) days after purchase (the “Warranty Period”). The Happy Penguin, at its option, will repair, replace or refund the purchase price of any The Happy Penguin product which, after examination, is determined by The Happy Penguin to be defective in material or workmanship during the Warranty Period. To obtain warranty service for a defect, you must first contact The Happy Penguin using this email: thehappypenguin00@gmail.com.

This warranty does not apply to damage that The Happy Penguin determines to be from repairs made or attempted by anyone other than The Happy Penguin, misuse, alterations, abuse, normal wear and tear, lack of maintenance, or accidents, any of which will void this warranty.

Return of the defective product and/or submission of photographs demonstrating the defect to The Happy Penguin may be required. A copy of the proof of purchase must be submitted to The Happy Penguin. If The Happy Penguin determines that your product qualifies for warranty repair, then, at The Happy Penguin’s option, The Happy Penguin will either ship to you a replacement or require you to return the product for warranty service or refund your purchase price. If The Happy Penguin requires you to return the product for examination prior to determining whether your product qualifies for warranty repair, you also must provide a credit card to cover shipping charges in the event your product does not qualify for warranty repair. Your card will not be charged if your product does qualify for warranty repair. If return of your product is required, The Happy Penguin will provide you with a prepaid shipping label and accept responsibility for damage during shipping only if you package the returned product in the same manner as it was shipped to you. If you do not package the product in the same manner as it was shipped to you, then you will be solely responsible for any damage during shipping. For all valid warranty repairs, The Happy Penguin will pay for return shipping to you. If your product does not qualify for warranty repair, then the credit card you provided will be charged the cost of shipping to and from The Happy Penguin.

ACCEPTANCE OF THE EXCLUSIVE REPAIR, REPLACEMENT AND REFUND REMEDIES DESCRIBED HEREIN IS A CONDITION OF THE CONTRACT FOR THE PURCHASE OF EVERY THE HAPPY PENGUIN PRODUCT. IF YOU DO NOT AGREE TO THIS CONDITION, YOU SHOULD NOT PURCHASE THE PRODUCT. IN NO EVENT SHALL THE HAPPY PENGUIN BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY COSTS, ATTORNEY FEES, EXPENSES, LOSSES OR DELAYS ALLEGED TO BE AS A CONSEQUENCE OF ANY USE OF ANY PRODUCT OR ANY DAMAGE TO, FAILURE OF, OR DEFECT IN ANY PRODUCT INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR LOSS OF PROFITS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS WARRANTIES, WRITTEN OR ORAL. TO THE EXTENT PERMITTED BY LAW, THE HAPPY PENGUIN DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE. All software, designs, text, images, photographs, illustrations, audio clips, video clips, artwork, graphic material, data and other copyrightable elements, and the selection and arrangements thereof, and all trademarks, service marks, trade dress and trade names which are part of or displayed through this Website (the “Materials”) are the property of The Happy Penguin or of third parties who have authorized The Happy Penguin to use the Materials and are protected, without limitation, pursuant to U.S. and foreign copyright and trademark laws.
